THE BOOT NURSE LLC – COACHING & COURSE AGREEMENT

This Agreement ("Agreement") is made and entered into by and between The Boot Nurse LLC ("Company") and the undersigned participant ("Client"), effective as of the date the acknowledgment box is checked at the time of purchase or enrollment.

1. Permission to Record and Use Content

By participating in any NCLEX coaching session(s), course(s), or discovery calls (“Sessions”), I, the Client, grant the Company and its representatives the irrevocable right to record, photograph, and use my likeness, voice, or performance for the following purposes, including but not limited to:

  • Internal training and development

  • Marketing and promotional materials

  • Online educational resources and paid courses

  • Social media content

  • Other lawful business purposes related to coaching or course services

I understand and agree that:

  • The Company may edit, use, and distribute recorded content without additional approval.

  • I will receive no compensation for the use of any recordings or contributions.

  • I waive any right to inspect or approve the final materials in which my likeness appears.

2. Confidentiality and Privacy

The Company agrees to maintain the confidentiality of any personal or sensitive information shared during Sessions. However, content used for public or educational purposes will exclude such information unless I give explicit, written permission.

3. Release of Liability

I acknowledge that all NCLEX-related services, including coaching and digital content, are for educational purposes only and do not guarantee a passing result. By participating, I agree to the following:

  • I release the Company and its affiliates from any claims related to NCLEX outcomes, including exam failure, financial loss, or emotional distress.

  • Coaching and courses are not a substitute for accredited nursing education or formal test prep programs.

  • I take full responsibility for how I implement strategies and interpret materials.

  • My success is determined by my effort, consistency, and application of study recommendations.

4. Assumption of Risk and Responsibility

I understand that:

  • The effectiveness of this program depends on my personal engagement, habits, and learning style.

  • Coaching and course materials are meant to guide, not guarantee, success.

  • I am responsible for applying any strategies or feedback discussed.

5. Indemnification

I agree to indemnify and hold harmless The Boot Nurse LLC and all associated parties from any claims, liabilities, damages, or expenses—including legal fees—that may arise from:

  • My participation in the coaching or course programs

  • My reliance on the materials provided

  • Any third-party claims connected to my involvement in the program

6. Emergency Consent (For In-Person Sessions Only)

For any in-person coaching or live events, I consent to receive first aid or emergency medical care if needed and release the Company from liability in such cases.

7. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of Texas. Any disputes shall first be addressed through mediation. If unresolved, disputes will proceed to binding arbitration in Texas, with the prevailing party entitled to recover legal fees and costs.

8. Severability

If any part of this Agreement is deemed unenforceable, the remaining provisions will remain valid and in full effect.

9. Subscription & Communication

By enrolling in any paid service or digital product, I consent to receive periodic emails regarding program updates, offers, and resources. I understand I can unsubscribe at any time.

10. Acknowledgment of Terms & Refund Policy

By checking the acknowledgment box at checkout, I confirm that I:

  • Have read and understood this Agreement

  • Enter into it voluntarily and am of legal age

  • Understand that The Boot Nurse LLC does not guarantee any specific results, including passing the NCLEX

  • Acknowledge that ALL SALES ARE FINAL, including:

    • Discovery calls

    • 7-Day NCLEX Course enrollment

    • Digital downloads, video sessions, and course access
